Is it illegal to not pay a person if he

forgets to clock in but clocks out when he leaves. Even when they know he was there.

Yes. An employer must pay its employees for all hours worked. While they may dispute whether you worked the time if you don't clock in, if it is easily proven that you did work the hours, they must be paid.
