Legal Question in Employment Law in Louisiana
My wife was summoned for jury duty. We live in louisiana. She is a social worker for a private company contracted by the state. They told her they would not pay her for jury duty, which the summons says will be for a week. She is a slaried employee. Also, they receive mileage checks every week for traveling to their in home visits. My wife informed me today that the owner decided to withhoild their mileage checks this week and gave no reason. Is all of this legal?

The employer does not have to pay for the employee reporting for and/or serving jury duty. However, the employee may take any leave they have available. Losing pay is not a good excuse for missing jury duty because then only unemployed persons would serve on juries. As for the employer not paying mileage for the employee's in-home visits with clients, that is a matter to be decided by the employment agreement. Failure to pay compensation owed as required by an employment agreement can result in legal action being filed, and in appropriate cases can result in monetary damages and attorney fees being ordered paid by the employer.
