Legal Question in Employment Law in Louisiana
I have been on withdrawal from the asbestos workers union for over 10 years working in management. The plant where I worked for 19 year with a signatory contractor with the union lost there contract with a non signatory contractor. I had to lay off all my employees at a certain date because the contract at the plant expired and we had no more work. I was offered a job in management with the non signatory contractor and to stay in the same plant I been in for many years. I quit the company I worked for for 24 years because they could not give me what the other company offered and I was going to have to take a very big cut in pay. The union sent me a certified letter saying that they are putting a fine on me and going to take my 31 year pension away that I am vested in. They also are charging me with taking union worker that I laid off to work with a non signatory contractor. The employees I laid off made there own decision and got there own application from the company them selves with out me knowing they did. I was asked if I would help them get hired and I told them they need to seek employment themselves and it has to be there decision to make. Can the union sue me? Can the union take my vested pension away? Can the the fine me? Can I sue the union for threatening me? This is a right to work state.

You will need to get a copy of your union contract and any other employment contracts and bring them to an attorney.
