Legal Question in Employment Law in Louisiana
I have been working under the table for 3+ years for a very rich stockbrocker. I was recently let go due to the "gulf oil spill". I know that this is BS because since the oil change he went on a 3 week vacation to Italy and then dropped 18k to put a cement fountain in his back yard. I know for a fact that I was let go so he could hire an illegal immigrant. During my employment I was injured on the job twice and was paying my own medical bills (even though they were aware of my injuries), however, now that I am not working I cannot keep paying them and I sent him a demand letter to pay my MRI and doctors bill, or I would file a claim on his homeowners insurance. Can I do this.

Let's see, you have been working for a fraud for 3+ years and now you want to file a claim against his insurance and you figure everything will be done according to the law. You complain that he wants to hire an illegal alien in your place....the difference being what? That he pays him less. I think you probably can sue him if you were hurt on his property and it was HIS FAULT or the FAULT OF SOMEONE HE IS RESPONSIBLE FOR. Then, he would turn you in to the IRS and produce 3+ years of 1099's to show you were an independent contractor and the IRS will want to know where the usual income taxes are, plus the self employment tax, plus penalties and interest. When you commit fraud with a fraud, you may find it hard to get justice.
