How do I answer to a small claims petition?

Unlike regular docket cases, small claims do not require any special legal knowledge to answer. All you have to do is either (1) write a written answer and mail it to the clerk of court for the court or Justice of the Peace where the case was filed, or (2) go down to that office and file an answer in person.

I recommend going there in person. Usually, all you have to do is to show up with the complaint and hand write an answer. They will have forms for you there, so you don't have to have anything drafted when you get there.

You are allowed to have an attorney in small claims cases, but it is certainly not required. Most people do not bring an attorney, but your odds of winning increase quite a bit if you hire one.
