Legal Question in Landlord & Tenant Law in Louisiana
I am buying a house from a friend and she is my mortgage company. The house is my name and the house papers were notarizes. I pay her every month on the 15th. If i do not pay her on that date after ten days i add on a fifty dollar late charge. I paid her in February but not March or April due to sickness. I will have all the money for march and most if not all for April by the 13th of May. When i talked to her about why i was late she said if i did not pay by may 15th. i will be consider 90 days late three months and be evicted. She said Feb to March to April. That is three months but i paid Feb. So it should not start counting until after march 15th, because if i do not pay on the 15th then i have ten days before a late charge. So three month 90 days would be June 15th. March15th to April 15th is 30 April 15th to may 15 60 may 15 to June is 90. So my question is who is correct. Can she evict me on may 15th, and does she have to take my payment because she said if i do not have it all she would not accept it. The papers just say after 90 consecutive days of none payment.
