do i have a defense if my landlord usually excepts my rent late due to my financial situation but after getting a report from the department of health and hospitals stating my 2 yearold has gotton lead poison from lead base paint on the porch and a bedroom door she served me with a eviction notice. what can i do?

Possibly. However, the lease may state that accepting rent late for one or many months does not affect the landlord's right to evict for future late payments. You should read your lease. You should also talk to an attorney in your area about the lead paint issue.

I agree with Mr. Lambert.....nowadays leases include the language he talks about. The lead paint issue is the real issue. Get an Attorney in the Jennings area right away. I am a Jennings native and can help you contact an attorney in that area.
