My friend recently found out her room mate been basically stealing money from her. My friend, along with two other room mates rent an apartment together. The three split the rent evenly, but my friend along with the other roommate both recently found out that the other roommate been overcharging them. They had to pay for application fees and security deposit, but when they finally went to the office to find out how much they had to exactly pay, they were told that the fees and deposit was waived because they attended an major college there. The first month of rent was actually discounted also, but the third room mate charged them full price. The room mate been telling them that the rent was $1,100 PLUS washer and dryer, but that was also false. The rent is $1,100, but that includes washer and dryer. My friend got the lease office to print out documentation stating that the application fee and deposit was waived, and the first month rent was discounted but the thing is that the first month rent, deposit, and application fee, my friend paid her cash.
How should we go about trying to get the money back? She tells them everyday she should just "kick" them out and "evict" them. All three people are on the lease, but the person that co-signed to get them the apartment was the parents of them roommate that overcharged them.
Can she even "evict" them?

The parent can remove themselves as co-signor but the only person who can evict Is the lessor on the lease. You will have to fail to abide by lease in order to be evicted. You can sue the roommate for monies owed. You should always check on details. You and the other roommate may want to make provisions to pay your portion directly to the complex. Never pay in cash unless you get a signed receipt from person accepting monies.
