Landlord won't repair, damage is causing sickness
My landlord received from insurance company about $13,000 for Hurricane Gustav storm repairs; for roof damage, inside water damage, torn skirting and torn awnings. He repaired the roof for about $2,000. He now refuses to make the rest of the repairs, I assume to pocket the rest of the insurance money. I am worried about the inside water damage as it has turned green and smells. I am sure it contains mold. Me and my 16 month old have since been showing symptoms of general ill in reaction to the mold. When confronted he said he will not make the repairs and is now talking about eviction. What are my legal options? Or is it simply a matter for the insurance company? Can I be evicted for 'forcing' him to repair by reporting fraud to the insurance company? Or should I pay for the repairs myself and charge the landlord? As you can see by my many questions that I am lost in what to do. Thank you so much for taking the time to help me.

If a landlord refuses to make necessary repairs after having been notified in writing of the need for the repairs, the tenant is allowed to have the repairs made by a licensed professional and to deduct the cost of those repairs from the rent.
