no lease

my daughter moved into an apt. w/her friend. The landlord never did get them to sign a lease. In the mean time the girl she moved in with went crazy while in Destin and my daughter decided to move out. The girls mother signed the lease for her but the landlord wouldn't let my daughter get her things out without paying the $300.00 dep. and 150.00 for the 1/2 mo. she lived there. Should she have to pay this since she didn't sign the lease?

Re: no lease

If she actually stayed in the premises, she is liable for the rent due, including any rent due for the next month if she did not give a 10 day vacate notice. However, if she did not sign the lease, she should not be liable for the deposit. In either event, the landlord is not allowed to hold her things for ransom. Louisiana law does not allow landlords to use self help. She is allowed to get her things.
