Legal Question in Landlord & Tenant Law in Louisiana
Last week I used the bathroom at my apartment. Mind you, I am a 150 lb. female and I did not have a sledgehammer at the time. This is an older apt with an older toilet. While using the toilet, it fractured and cracked and resulted in a broken toilet bowl and water shooting out everywhere. We tried to turn off the water valve and it was stuck. When maintenance arrived, it took him a good bit to finally shut the water valve off. Unfortunately, gallons of water were spraying everywhere and ruined the carpet in the apartment. We replaced the toilet and steam cleaned the carpet the next day at our own costs. The real issue was caused by the stuck water valve, resulting in the water flooding the apartment. The carpet will need to be replaced due to the mold and mildew that is already starting to grow. The landlord will not return our calls and the apt. is virtually inhabitable. Who is liable?

It will depend on the terms of the lease but it should be the landlords responsibility.
