Legal Question in Medical Malpractice in Louisiana

Dental malpractice

Approx. 10 yrs. ago, I had a root canal done and a cap put on one of my back teeth. I hadn't been back to the dentist since then until this March 2001. An X-ray revealed a foreign fragment of something left in my gum during the previous root canal. I need oral surgery to remove this thing and it is infected and I need a new cap on it. It will cost a couple of thousand dollars. Is this dentist that left the fragment in my gum liable for the cost of fixing it and for the pain and aggravation caused by having to fix it? I don't have any records.

Unfortunately, you have 1 year from when the negligent procedure was performed, or 1 year from when you discovered the malpractice, to make a claim, but in no case may you bring a claim more than 3 years after the negligent act.
