Legal Question in Medical Malpractice in Louisiana

forced to dismiss a lawsuit against a physician

I am in a situation where a lawsuit against a physician has been filed for medical malpractice. He is a dermatologist who went against the standard of care by giving me injections that were not indicated and I have been left with glomerulosclerosis and bone marrow suppression.

The physician was and is practicing in bankruptcy with no insurance to cover the damages he does not contribute to the Patient Compensation Fund. The attorneys will not pursue the case because there is no way to recover the damages. Is there anything I can do? The State Board is also invovled.

I need to know a little more about his lack of med-mal insurance or a bond. Maybe he was affiliated with a clinic or hospital, or another doctor who might be responsible for his actions, or for his failure to have insurance. If not, then you might be out of luck. However, there may be a fund which the doctor's professional society maintains for patient's injuried do to the malpractice of an unlicensed physician. Or, maybe the licensing agency did not do the proper check to insure the doctor had insurance or had put up a bond. I just don't know enough. Assuming the attorneys you retained have tried everything, there may be no where to turn, except to get a judgment and try not to allow him to discharge it in bankruptcy.
