Legal Question in Medical Malpractice in Louisiana

postop infection

My husband contracted staphylocuccus aureus due to surgery, he was hospitalized because the anitboics was not working to kill the infection. My insurance company has denied to pay his hospital bill, what can we do to get help paying this large hosital bill? Stressed in Louisiana.

Post op infections are very common. Your husband's health care insurer would seem the obvious liable party. However, you should take the policy and whatever you have from the insurance company explaining why they are refusing to pay to an attorney for his advice. I am just guessing, but this may be one of those cases where the insurer uses the excuse that it is their opinion the infection is not a part of what they agreed to pay for, and that someone's "negligence" caused the infection and therefore that party should pay the costs of treating it. Basically they are telling you you should sue the hospital and/or doctor responsible.
