Legal Question in Military Law in Louisiana

Car Wreck

A friend of my husband's was driving our car (with my husband in the passenger seat) and ended up hitting a parked car, and did $2,600 worth of damage to our vehicle. He has only paid us $200 on the damage and this happened alomost a year ago. He is refusing to pay us anymore, and I was wondering if we could just go ahead and sue him for the remaining amount? We have the police report of the accident, the reciepts when he paid us, and the estimate. Our insurance wouldn't cover ''non-insured'' motorists either. Thanks for your help in advance!

Assuming your friend is active duty military, your husband or you could possibly submit an Article 139 Complaint. The purpose of an Article 139 Complaint is to provide a means for individuals (civilian or military), business, or state and local governments to receive restitution from loss, damage or destruction to their personal property (or property in their lawful possession) by military members of the Armed Forces of the United States. Generally, a claimant must submit their claim within 90 days of the incident, unless there is good cause for the delay.
