Legal Question in Personal Injury in Louisiana

I was in an accident and the other driver was at fault because he ran a stop sign and he was driving his sons car and the insurance company said he was an excluded driver and couldn't do anything. I would like to know who is responsable for my damages?

The driver and the owner are still personally liable for your injuries. If either of them have assets (a steady job, a home, a car, etc.), you can sue them personally and get your money. If they don't have any assets, they may be what attorneys call "judgment proof", which means you could get a Judgment, but you would have no assets to satisfy the Judgment. If that is the case, you could be throwing good money after bad if you sue them.

I would do a little research. Go to their home, or look it up on GoogleEarth and see if it is a big home, whether they have a new model car, etc. If they appear to have the means to pay a Judgment, sue them.
