Legal Question in Personal Injury in Louisiana
auto accident
My husband was in a wreck last night. He was turning left and a car passed him on the left as he turned and demolished our car. We only have one car. The person who hit him has no insurance. Can we sue him? We have gap ins. how does it help us get another car?

You can sue him, but if he does not have anything to seize (a regular paycheck, a home, a bank account, etc.), it may not be worth pursuing him. Unfortunately, some people are what attorneys call "judgment proof", meaning they simply do not own anything of value and any judgment you get against them would be worthless.
