A back seat passenger in my vehicle was in the act of stepping out of the vehicle without my knowledge as I was stopped at a stop sign. When I began to pull away he was injured am I at fault?

Yes, although your case sounds like one where what attorneys call "comparative fault" comes into play. More than one person is often at fault for an accident. Court often assign percentages of fault, which equate to percentages of a Judgment. In other words, if you are 50% at fault and your passenger is 50% at fault and your passenger suffered, say $10,000 in damages (for easy math), you would owe $5,000 of that amount.
