Legal Question in Personal Injury in Louisiana

I was in a car accident, the driver was my husband. He got upset during a conversation we were having so he sped up and started driving crazy. He side swiped two cars and ran into a light pole. I've had two surgeries since then and my insurance has covered most of my bills. My question, can I sue him even though I was not wearing a seat belt?
