Legal Question in Personal Injury in Louisiana

Car Accident

I was involved in a car accident because of a tire blowout. My insurance company says that I am at fault, however no one was ticketed. Will accepting the fault from my insurance company keep me from suing the car rental company, the tire manufacturer and the hospital which misdiagnosed my injuries?

No one should say that you should file suit without reviewing the facts of the case, that is irresponsible. I would want to know what the facts are; what you expect your insurance to be liable for; and why they say you are at fault. One thing is for sure, you do not have to "accept" what your insurance says. They were not in the accident, and they did not witness it. However, since the tire and the rental company car are critical to your case you must contact a lawyer in the Parish where the accident happened and sit down with them so if you have a case, they can take the necessary steps to preserve the evidence.
