Legal Question in Personal Injury in Louisiana

Car accident & pedestrian hospitalized

My brother got hit by a pickup truck while he was riding his bicycle. Currently he is hopitalized in Baton Rouge General. He will be using a wheel chair for the next year and probably for life. How can I pursue legal action? and How can I ensure that all medical and related expenses will be paid?

Please, advise asap.

Sincerely,

Contact a lawyer. Your brother needs representation by someone capable of pursuing and collecting his claim.

The issue of liability is important. If your brother was, for instance, 50% at fault, his recovery could be limited to 50%. That is an issue to be ironed out between an insurer and an attorney, and an important reason why you should consider getting an attorney. An attorney should be able to iron out liability as well as the amount of damages. Your brother may be entitled to damages for a number of items of damage, including medical expenses, disability, earnings losses, earning capacity losses, and a general award for pain and suffering. Personal injury attorneys work on contingency contracts in most instances and invest the money for court costs. If I can assist you, I am an attorney in New Orleans and I handle personal injury cases.

Find an attorney....if there is insurance, then he may take it for a percentage of the amount recovered. However, understand that the minimum insurance coverage mandated by state law is only $10,000, so just reading your post, it seems that the medicals will eat that up....an attorney can assist you with other avenues of recovery if available.....also, if liability is NOT an issue, make sure the lawyer does not take his percentage from any amounts recovered for medical bills incurred.....
