Legal Question in Personal Injury in Louisiana
i was in a car accident May 14, 2009, I was receiving neck and shoulder treatment but my lawyer advised me to stop treatment because he couldnt verify the other driver's coverage, so i did. It is almost a year and my attorney hasnt filled suit against the driver at fault and it will be a year that the accident occured. Now I'm having soulder and neck prblems because treatment was stopped as per my attorney. can i sue my attorney if he drags his butt in filing this suit in the next 10 days? what are my options legally and medically.

Just sitting and waiting out the ten days is a very bad idea. You should contact the attorney and confirm whether he is going to file suit for you. Make sure he and his staff know the problem and that you want to file suit before the deadline. If he is not willing to represent you, you still have time to find another lawyer to file suit, but you have to act FAST. Once the deadline passes, you may have no recourse left at all.
You need to file suit.....forget the other attorney.....also, did you have uninsured motorist coverage.......not being able to confirm insurance in a year, or in a month is suspicious. Get someone to file the suit to preserve your rights. If you let it prescribe, you may be able to sue the lawyer, but not for what your case may be worth. You knew about the year time period, so if you let it expire, that is YOUR fault.
