Not unless you think you are getting the runaround. The insurance company must adjust your property damage in a timely manner. You furnish them the repair estimate or they do it and then ask for something for your pain and suffering. If you are satisfied, take it and save 1/4-1/2 for attorneys fees. Even if you get an attorney you should not be charged a fee on the car damage or the medical bills since fault is not an issue and those numbers can be easily computed.

Car accidents are perhaps the easiest thing to find representation for. There are literally thousands of attorneys in the state who exclusively (or nearly exclusively) handle auto accidents--including my office.

An auto accident attorney can get your car repaired for you, get you seen by a competent doctor and rehab facility, and take care of the entire process for you. All of the costs will be paid by the insurance of the car that hit you, so you won't have to come out of pocket for anything. Like me, most will also charge you nothing if they take your case and do not win. So, there's no real risk for you. The attorney takes most of the risk.

My best advice is to find an attorney IMMEDIATELY. There are many good ones on this site, or you can ask a friend for a referral. Do NOT allow the insurance company's adjuster interview you. Do not speak to ANYONE about the case until you have retained a lawyer. Good luck!
