Legal Question in Personal Injury in Louisiana
Civil Damages
I had a friend who was after me for over a year. When I started to date him he said he wanted to help me because he was more fortunate. He begged me to pay off two credit cards and I let him. He turned out to be astalker. I told him to stay away but I would repay him when I could. After 2 months he cancelled the payments somehow that cost me over-the-limit fees and returned fees. He then told friends that I stole the money from him and was asked about it. I have never stole money in my life. Do I have any type of civil actions against him. When he cancelled those payments after two months it has cost me alot of damage to credit score and other accounts. How can you beg to help someone and when things dont work out just take everything back and cost me even more money? How can you go around and tell people I am--name removed--theif?

Re: Civil Damages
Sounds like you may have grounds for a protective order since you did have a sort of domestic relationship. Also, calling someone a thief is libel/slander per say, which is to say that whether it is printed or uttered by mouth, truth is the only defense. Additionally, if you can prove that when you wanted to break it off he caused you damages, you may have an action for those. So, you have several choices, all of which or none of which could turn out in your favor. Therefore, sit down with an attorney. It may cost you more money to hire the lawyer, but in the long run it may save you alot of grief and even more money.
