Legal Question in Personal Injury in Louisiana

My daughter was riding as passenger on the back of a friends crotch rocket motorcycle. She told him not to go fast with her on board. He ended up going 120 mph at one point. He passed up a truck at that speed. Then got back into the right lane in front of them slowing down a bit. Then he speeded back up and my daughter came off the back of the bike at anywhere from 80 to 100 mph. She got really lucky. She had road rash really bad and nothing broken. she has been in the hospital for 8 days. My daughter is 19 and when she went into the hospital she went in under our medical insurance humana which she is covered on. The night of the occurance the police where not called. and they could not make a report. The two guys in the truck had to slow down not to run over my daughter. They witnessed the whole thing. They also said that the back seat on the bike came off when she did. They thought she would be in pieces when they turned aroud and went back to her. The truck guys picked her up and put her in the truck as the motorcycle driver came back to help. They all went to the hospital with her. They will be witness if we need them. My question is that the bikes insurance company came to her and asked to give her $15,000.00 which Progressive the insurance said was the maximum liabilty coverage.And will Humana still cover her under thier policy or will they want the 15000.00 of the money progressive gives her. She is Short of funds for an attorney please help! Thanks in advance
