Legal Question in Personal Injury in Louisiana

Disfigurement along with injuries.

I was involved in an auto accident in witch the other driver was at fault. I sustained injury witch resulted in a very noticable scarring to the middle of my forehead along with other substancial injuries to witch I am still feeling the pain. My question is, should/or how should a settlement claim differ in a case like this if physical pain is eventually releived but the scarring lasts a lifetime.

Settlement for scarring

Under Louisiana law, scarring is like any other physical injury. All settlements are ultimately based on awards made by courts for similar injuries. The only reason an insurance company makes a settlement is because it recognizes that a trial may end up costing more than the settlement. If your case would go to trial, you could recover for all your physical injuries, including your scars. You could also recover wage loss, past and future medical expenses (including future cosmetic surgeryon the scars) and other economic losses. Courts look at various factors in determining fair compensationfor a scar. These factors include the sex of the victim (scars on females result in more awards than scars on males), the age and marital status of the victim (young, single persons are more affected by scars than older persons),the occupation of the victim (scars may affect earnings of some jobs), and so on. There is no hard and fast rulefor determining a fair settlement amount for scarring. My firm handles personal injury cases such as yours.
