Legal Question in Personal Injury in Louisiana

Emotional Distress

This may be difficult to understand, but I will try my best. I was wondering if it is possible to sue for emotional distress due to the judgement made by a judge. This judge was a friend of my dad's and made unfair judgements against my mother over a period of four to six years. I was around nine years old, and currently I am twenty years old. I wanted to sue this judge for emotional distress caused by his unfair judgement. He basically ran my mom into the ground with unfair judgements against her, favoring my father. I have a copy of all the depositions and even the Court of Appeals read them and said they could tell he was not a fair judge (in a separate case). The divorce could have been simple and easily done but the judge dragged it out because one of my dad's clients is an attorney and did not charge him. On the other hand, my mother had to pay each time to be represented in court. The judge was eventually thrown out due to other rude remarks he made on several occasions in the courtroom. He now works for my dad's lawyer's firm (believe it or not). Would it be possible for me or my mother to sue for emotional distress caused by his unfair judgements. Thanks for your time.

Re: Emotional Distress

I am sorry that your experience was so bad.

I am also sorry to tell you that judges have immunity from suit for their actions as judges. While this may seem unfair, having judges sued for every decision that they make (remember somebody loses every case) would be worse. There probably is no lawful cause of action.
