Legal Question in Personal Injury in Louisiana
finger joint slashed
my son had an accident at a skating rink where he was taken for a group outing by the LA national guard. he was a cadet at their YCP camp and was staying at a dorm there for 5 1/2 months. it was 1 week b4 graduation and they went took the kids on an outing. my son ran into a wall they said was ''plexiglass'' but his finger got slashed off at one of the joints. it was his right middle finger and he is right handed. this happened 8months ago and my son still has trouble using that hand for writing. he is on medicaid and they (LANG) used the card for his ER visit. i would like to know if either party was liable for my son's injury and if so, is there still time to make a claim.

Re: finger joint slashed
First, there is definitely still time for you to make the claim...but, not much time. You have one year from the date of the accident/injury to bring suit. I suggest speaking to an attorney immediately about this matter to protect any rights you/your son might have.
In regards to whether either the LA National Guard or the skating rink operators are liable for the injury, the question can become complicated. More facts about what happened are needed before I would be ready to answer this question of liability. Either party (or both parties) could be liable for this accident if they were negligent in some way.
Both parties owed your son duties (to keep the skating rink in proper order for the rink owners or to properly supervise to the guard). More facts, however, are needed to determine if those duties were violated.
Was it glass instead of plexiglass next to the rink? If it was glass, is that an avoidable danger? Etc...
You should speak to an attorney about this case in more detail, and as mentioned, you should do so very soon as the claim will expire on the one year anniversary of the accident.

Good luck sorting all of this out.
