Legal Question in Personal Injury in Louisiana

Good Samaritan Law

In my reading I found no reference to those who are CPR certified or just a layperson helping out in an emergency situation. Currently I instruct CPR through NELA Red Cross and the manual gives the student the idea that they would be legally covered. Is there a law protecting these individuals. Where can I locate this law?

Re: Good Samaritan Law

Dear Law Guru Friend,

I am not at my office where my law books are. However, tomorrow I plan to look up the answer to your question: whether there is some type of a good samaritan law that protects one who administers CPR, especially one like yourself who is trained and certified as a professional CPR expert. My guess is that such a statute does exist in Louisiana. Congratulations on obtaining that training! Best of luck! Perhaps someone will come on and give you a better answer and a faster one. However, look for another answer from me very soon! Best of luck!

Sincerely,

Hardy Parkerson, Atty.

Re: Good Samaritan Law

Louisiana Revised Statute Title 9 section 2793 (RS 9:2793)covers the "Good Samaritan" situation. You should be able get a copy from any law office or the District Attorney's office. You can also go on the Louisiana Supreme Court website and go to find law and you can print a copy. If you can't, email me with an address and I will send you a copy. By-the-way, the "Good Samaritan" concept applies to persons who in good faith render aid in emergency situations. It does not apply to those in the business of responding to emergencies and rendering assistance.
