Legal Question in Personal Injury in Louisiana

my lawyer is stalling my case until my surgery, in case it proves the defendents are responsible. I want and need this settled immediately- but he does not want to settle. The defendents have already offered a settlement. What can I do to settle this asap?

You can demand the attorney settle the case as it is your case, the attorney is representing you. If the attorney fails to do as you demand, you can fire them or contact the Louisiana Disciplinary Board. However, slow down and think about what the attorney is telling you. Perhaps they are concerned that the settlement will not compensate you sufficiently for your injuries. Perhaps they are concerned about future medical expenses you may incur as a result of this injury and want a clearer picture of what you are facing. This information may not be available until after your surgery. Once you settle, you cannot go back and receive more even though your injuries may be more severe, long-lasting or complex. While it is very hard to wait for closure, it is often wise not to hurry. My advice would be to try to be patient.
