Legal Question in Personal Injury in Louisiana

Third Party lawsuit (offer)

I have a Third Party lawsuit and they are wanting to make an offer. I was injured at work and have had 3 back surgeries (spinal fusion was 1) and knee surgery. My lawyer said $500,000 would be a number to except. I was thinking a higher amount. Is there a way to figure this. I am also on Disability now because of the injury.

Re: Third Party lawsuit (offer)

The most important thing to remember is that your lawyer is looking out for your interests, but you are ultimately in charge. You are always the sole decision maker when it comes to making and/or accepting offers. Your lawyer can only advise you. If you don't like an offer, you are always free to decline it.

That being said, your lawyer has absolutely no reason to short change you. If you are paying your lawyer a percentage of your recovery (and you almost certainly are), the more money you make, the more money your lawyer makes. Your lawyer is going to try to squeeze every penny he can out of the defendants because it puts more money in both of your pockets.

Lastly, if your lawyer got the other side to the settlement table at all in a $500,000 case, he is likely doing a very good job. Companies don't give up that kind of money willingly, so it sounds as if he has got them on the ropes. Don't second guess him now by asking other lawyers about the case--talk to him and have him explain why he thinks the case is worth what he says. He will likely satisfy your curiosity.

Good luck!
