Legal Question in Personal Injury in Louisiana

Past auto accident

I was involved in an auto accident back in 1990, the other vehicle did not have insurance but I did but was dropped immediatly. One of the passengers in the other vehicle tried to make a claim against my insurance but was denied and so they filed a petition against me. Nothing was followed up after it was filed. It has been 17 years and I just found out about it and the attorney has a lean on my licence. Now is there a limitation on the petition that has not been followed up on? and is it legal for the attorney to give his client my number and have him call me to settle? And if this is no more good what kind of attorney I will need to have it thrown out for abandonment?

Re: Past auto accident

Any case that has not been acted upon for more than three years is abandoned. You should certainly not engage in any negotiations, or do anything that could be seen as your assent to waive the abandonment. You should file a motion to dismiss on the grounds of abandonment immediately. Any lawyer can do it for you, if you no longer have one.
