Legal Question in Personal Injury in Louisiana

My propery was damaged when a vehicle drove through my lawn and struck a tree. The driver fled the scene and it was later determined the driver was not the owner. The owner left the keys in the ignition for a mechanic to work on the the vehicle while he went out of town for a few days. The insurance company denied my claim since they say the owner doesn't know who was driving. Is the owner responsible for my damages and should I take him to court?

No. The owner did not give the driver permission to use the vehicle.
