Legal Question in Personal Injury in Louisiana
Situation: While lifting an item into a shopping cart, a woman loses her balance and falls. She is helped to her feet by another customer, and her hip hurts. A store employee happens by and offers to get a motorized cart for her to sit on, and walks off to the parking lot to get one. He does not return, but another customer enters on a motorized cart. A second employee offers and then brings a cart and the woman sits. In the meantime, she has called her son by cell, and he arrives and takes her to the hospital since her hip hurts so badly. She has a fracture and requires insertion of screws and a few months' recovery. This woman does not intend to sue the store since it was in her words a "simple accident."
What liability does the store have, especially considering the first employee's offer and inaction?
