Legal Question in Personal Injury in Louisiana
Can I Sue A Restaraunt For Eating their Food And Breaking Out With Rashes?
1 Answer from Attorneys
If you can prove that they were responsible for the rashes, yes. If it was some allergy you have, you would also have to show that you were not at fault as well (i.e., you didn't order shrimp coctail and you are allergic to shrimp). Most restaurants will disclose any item in their dishes which contain known allergens, like peanuts or shellfish. If they disclosed it and an allergic reaction to that food occurred, the fault would not be theirs. They are only responsible to disclose allergens in the food, not to guarantee that you aren't allergic.
Most likely, you have simply developed an allergy to some food. You should probably talk to your doctor first and rule that out. Only if you can rule out a common food allergy should you begin to look to the restaurant for recovery.
