i bought property at the end of a road.. the person that bought property next to me has busted my water line. i have called the local water company and they state that it is my responsibility to fix although the water break is not on my property at all. i went over to talk to this neighbor about the problem with my water only to notice a shovel and dirt. i called the local sherrifs department who are not getting involved however the neighbor admitted to breaking the water line and is refusing to fix it. How is it my responsibility to remove his pit bulls, kennels and then repair a water line he admitted to busting? if i pay a plumber to do this do i have any rights in small claims court to recoup my money? also how do i have a right to go on his property and move these things without having problems with trespassing since this neighbor is already refusing to be helpful?

I would not go on his property without at least giving him fair notice. You should send him written demand that he fix what he broke. If he fails to do so, I would send him another written notice that you have to go on his property yourself to repair it. Once you have everything repaired and you know the cost, file suit in small claims court for reimbursement. In a justice of the peace court you can sue for up to $5,000.00.
