Community Property Laws

If I own my home outright and marry what rights do the children (if any) of that person have. How can I protect my property in case of the death ofthe person who I marry.

I am assuming from your question, you already own the property, and you may be getting married later (after you purchased the property.) Your future spouse's children normally would not have a claim to the property. I always advise clients to do a simple will to ensure their property is distibuted according to their wishes. If you do not do a will, the state has already enacted laws that determines who gets what. While your future children do not normally inherit directly from you, they could eventually get the land if your future spouse acquires it after your death, and then leaves it to them.

My advice is consult with an attorney and execute a will that is based on your wishes.
