Legal Question in Real Estate Law in Louisiana
We have an encroachment issue with a severitude. The severitude was given in 2006 as a 20ft x 442ft, a tempoary access was granted from exisiting driveway to severitude during construction. 4 years later after I paid for a survey it was discovered the road was laid off of the severitude , now the gentleman is claiming that he has had access for four years and he doesn't have to relocate he driveway.
*foot note* The gentleman in question built his home on land he did not own, and in June of 2009 aquired ownership of his property.

An easement of access is only allowable if there is no other way to access property.
