Legal Question in Real Estate Law in Louisiana

Eviction / Probate

I moved into a house about 2 months ago in Baton Rouge, near LSU. My roommate, Sonya, has been there since May, when at the time she signed a 2 year lease. I was away at work, when 3 men, one of them a lawyer, came to the house and told Sonya that we have to be out in 2 weeks. The house is in probate and that we cannot stay any longer.

Can a lease be voided while a house is in probate?

What is the length of time that we should be given before being evicted?

Is there anything that I can do about this?

Please get back to me as soon as possible. Thank you.

Re: Eviction / Probate

A written lease contains the conditions underwhich the lessor and lessee are to operate. If the lease was entered into with a party who was authorized to bind the owners, then it would appear they are stuck with you for 2 years. However, contact the lawyer who accompanied the others to the house and said you had to move and simply ask him under what authority they are breaking the lease.
