Legal Question in Real Estate Law in Louisiana

A friend found an apartment through a Real Estate company and put a $500 deposit down on the property while waiting for Section 8 to finish processing her paperwork. After almost a month later the paperwork from Section 8 was not finished. Upon going to the property, my friend found the property filthy and decided it was not suitable and no longer wanted to rent the apartment. No lease was ever signed and now the property owner wants to keep the deposit because she said the property was held up for almost a month. Is this legal even if there was no signed lease?

If they did take the property off the market for your friend, then it sounds like a fair deal. The problem may be that the company is marketing the property as Section 8 housing and puting up that large of a deposit does not sound right to me. But I am no expert. The friend should check with section 8 about special rules etc. Something else, how could your friend put that kind of money up and not know what the property was like?
