Government's burden in eminent domain
The FAA is taking a relative of mine to court to institute condemnation proceedings in order to obtain some land he owns. What must a federal agency show in order to prevail in an action such as this?

A "need" that the government has that there are no alternatives for other than taking the property involved. However, they must pay fair market value AND any damages which might result, especially if this property was revenue producing.
