Legal Question in Real Estate Law in Louisiana

irrevocable trust for real estate property

My mother has a home in LA that is paid for. Can this property be placed in an irrovocable trust to prevent Medicaid from placing a lien on the property if she goes to a nursing home. The property is not worth more than $100,000. My wife suggested having her quit claim the property over to my brother and me. Medicaid has a 36 month look back so if she doesn't use benefits the property would be exempt from Medicaid estate recovery after her death. Is this correct? Should we put the property in an irrovocable trust or some different trust? She does not have a revocable trust. Thank you.

Re: irrevocable trust for real estate property

Your mother, not you, should contact an attorney that has knowledge about elder law and estate planning. Unless this matter is properly done you may end up with a very expensive surprise after her death.
