Legal Question in Real Estate Law in Louisiana
My land is in rural La. on a private servitude. Each side put up 20 ft. for the lane. The home across the lane is much further up the lane and nearer the main road than mine. My side is pristine for the most part and kept mowed. Across the lane is privot and myrkel that hangs over the lane and scratches my car. Most of it originates within a few feet of the neighbors fence. Storms and snow sometimes bring this stuff down to block the road. The neighbors across the lane never remove it. I began to cut this brush back on my own almost to the fence to keep from regular trimmings. Across the lane is threatening to sue me because I have disturbed their privacy. Do they have a legitimate suit against me? They have never done one thing to contribute to upkeep of the lane...gravel or grading. Grading can't be done correctly because of brush.

Under Louisiana Civil Code article 688, a landowner has the right to demand that the branches or roots of a neighbor's trees, bushes, or plants, that extend over or into his property be trimmed at the expense of the neighbor.
