Legal Question in Real Estate Law in Louisiana
We live next to a Chevron Plant in Opelousas, Louisiana that was recently bought out by Buckeye Partners, L.P. They want to buy two acres in the back of the plant. They are offering $30,000.00 per acre. My question is if we decide not to sell, can they make us sell it to them, being our property is keeping them from expanding?

Eminent domain is usually reserved for government purchase of land. You should be able to refuse.
$30,000 per acre in Opelousas is darn good money. What if they decide they do not want the property and expand in another direction? Can you get the same amount of money for the acreage? Of course if you do not want to sell, you don't have to. However, there have been other states which have decided the expansion of such a plant is economically advantageous to the State/municipality, and have allowed the plant owner to appropriate the property. If that happens, all they owe is the fair market value of the property, not what the property is worth to Chevron.
