Personal injury settlements are separate property even if you are married. However, once you comingle that property with community property, it loses its separate nature. You need to keep the funds totally separate and have her sign a document at the Act of Sale stating that you are using separate funds to purchase the property and keep it separate. You should contact a family law attorney to assist you with keeping it all straight. The attorney handling your accident case can likely assist you or recommend someone who can.
