Legal Question in Real Estate Law in Louisiana

My's best friends Brother passed and was cremated. His wife had the ashes, but she moved around a lot and soon gave the urn to my friend to keep until she could get settled. After several years she decided since my friend had them so long, she told her their yours you go ahead and keep them. But now after several more years, she has decided she wants them back. There are no written agreements, and no witnesses, What are legalities involving this, how can my best friend insure she can keep her brothers ashes.

It would have to be decided by suit. There seems to have been a gift or donation to the sister.
