Legal Question in Real Estate Law in Louisiana
Neighborhood Fees
I live in a private community of only 30 homes. We have a small park and pool. Everyone is charged $35/quarter for pool upkeep. I don't feel it's fair for people who don't use the pool to have to pay for its upkeep. My grandfather lived here before he died and adamantly refused to pay the pool fee because he never used it so they removed it for only him. The neighborhood treasurer told me recently that if it's up to him I will not be grandfathered in to the same deal and will be made to pay the quarterly fee. He also told me 90% of the residents do not use the pool yet they pay the fee because it adds resale value to the homes. I disagree with that as my old home had its own pool and spa and my inspector, realtor, and broker all three told me a pool adds no value to a home only curb appeal so I don't see how a community pool is any different. The pool has a locked gate and only those that pay the fee get a key so it's not like those that don't pay have access. I don't feel it's fair for those that don't use it to have to pay the same amount, or at all, as the ones that do. What legal grounds do I have to stand on? Thank you. Not sure what area this belongs in so I'm putting it in Real Estate.

Re: Neighborhood Fees
You probably have no grounds except they let your grandfather get away with it. Therefore they have allowed the alteration of the rules.
