Should the owner of a private dirt road, be liable for the maintenance and upkeep? There are 3 families that this is the only way to their homes.

It would depend on several factors, most importantly whether there are any servitudes attached to the road, such as a right of way. If there are, they would be recorded in the conveyance records and in the acts of sale for the properties. If there is no such recorded obligation, the owner does not have to maintain the road.
