Legal Question in Real Estate Law in Louisiana
As part of my divorce decree, I was to refinance the house in order to get my former spouse's name off the title. Because the house was worth less than what was owed, I was turned down by 2 banks. My only solution was to sell the house in a short sale. I have an offer to purchase home, and 1st mortgage has approved it. Problem is 2nd lien holder will not sign off because they are requesting ex's financials. My ex refuses to submit any info and therefore sale is halted. Divorce decree states that house is mine. Is there anything I can do to make this sale happen, otherwise it will go to foreclosure?

Talk to your divorce lawyer. He can get an emergency hearing in the divorce action and have the Judge compel your ex to cooperate in the sale of the home.
