Legal Question in Real Estate Law in Louisiana

Selling trailer and not paid for

I recently had to sell my trailer and the lady I am selling it to agreed to pay 1500 for it, i tried before leaving the state to offer to sell it to her for 500 so i wouldnt have to deal with it anymore. It has been over 9 months and so far all i have managed to do is get 200. I sent her a letter telling her i needed the rest of the money owed or she needed to leave. Not sure if i have any legal standing since there is nothign but a verbal contract. although the title is still in my name. She has supposedly put 6500 worth of work into it. any help would be greatly appreciated?

Re: Selling trailer and not paid for

You do have a cause of action against here, even though the agreement was only verbal. Oral agreements are valid in Louisiana....the trouble is really "proving" them.

Here, you have a few problems:

1) proving the exact terms of the agreement;

2) brining the action in a cost efficient manner

Hiring an attorney will likely cost you more than the claim is worth. You want to be cautious there.

Put as much documentation, correspondence, etc. together as possible. You can even prove your agreement by showing previous payments, and making inferences on the payments.

Perhaps you want to start by sending a demand letter, and followup with a small claims suit (although your dispute may be too much $ for the small claims court in your jurisdiction. Call the court to find out).

Good luck.
